Copyright Under Saudi Law: What It Protects and What It Does Not

Many Saudi creators do not realize copyright protects them automatically from the moment of creation — without any registration. But "legal protection" is one thing, and "ability to prove it" is entirely another.

What Copyright Protects in Saudi Arabia

Literary works (books, articles, poetry), artistic works (paintings, photographs, sculpture), musical works (composition, arrangement), films and documentaries, software and databases, translations and adaptations.

Does not protect: abstract ideas, facts, business methods, theories. Protects the "expression of an idea," not the idea itself.

When Does Protection Begin and How Long Does It Last?

Begins automatically from the moment of fixation in a tangible form (writing, drawing, recording). No publication or registration required.

Lasts the author's life + 50 years after death. For joint works: 50 years after the last author. For works owned by legal entities: 50 years from publication.

Rights Granted by Copyright

Economic rights: reproduction, distribution, public performance, broadcast, translation, adaptation. Transferable and licensable.

Moral rights: right of authorship attribution, right to object to distortion, right to withdraw work. Non-transferable even if waived.

Proving the Right in Disputes

Protection is automatic, but proving it in litigation requires evidence of priority. Acceptable evidence: registry deposits (with Ministry of Media or SAIP), documented publication dates, witness affidavits, historical emails, timestamped copies on platforms like GitHub (for code) or Wayback Machine (for digital content).

Investing in early documentation costs hundreds of riyals and saves thousands in dispute.

Enforcement Procedures

Cease-and-desist to the infringer, DMCA takedown for online content (if international), civil action for damages, criminal action in commercial forgery cases.

Saudi penalties reach SAR 250,000 fines + 6 months imprisonment, plus civil damages for harm.

Summary

Copyright is the strongest IP protection a creator gets at zero cost. But the smart move is "building evidence" — documenting dates, preserving copies, using timestamped platforms.
